Terms of Service
By accessing our website and/or placing an order with Higher Up Apparel (“we,” “us,” “our”), you agree to the following terms. If you do not agree, please do not use our site.
Products & Made-to-Order Production
Many of our products are printed on demand (made to order). Colors and placement may vary slightly from what you see on screen due to differences in monitors and the printing process.
Custom Orders (Approval Required)
For custom orders, we require approval and payment before printing begins. We may provide a test print and require customer approval before the final print is completed. Once approved, custom orders are produced specifically for you and are generally final sale except for issues caused by our error (misprint, damage, wrong item).
Pricing & Payment
All prices are listed in U.S. dollars unless otherwise stated. Payment is required at checkout (or prior to production for custom orders). We reserve the right to correct pricing errors and to cancel orders affected by obvious mistakes.
Shipping
We currently ship within the United States only. Shipping options, rates, and estimated delivery windows are shown at checkout and may change over time. A pick up option is also available. Currently at 12208 Canyon Drive, Amarillo, Texas, 79119.
Returns & Refunds
Our Refund Policy applies to all purchases and is incorporated into these Terms by reference. Due to the made-to-order nature of print-on-demand items, we generally do not accept returns or exchanges except for damaged/defective/incorrect items handled case-by-case.
Cotton Apparel Care / Shrinkage
Many items are cotton or cotton-blend garments. Some shrinkage may occur depending on washing and drying methods. To help reduce shrinkage and preserve print quality, we recommend washing in cold water and tumble drying low (or hang drying).
Intellectual Property
All content on this site (including designs, logos, product photos, and text) is owned by Higher Up Apparel or used with permission and may not be copied or reused without written consent.
Limitation of Liability
To the fullest extent permitted by law, Higher Up Apparel will not be liable for indirect, incidental, or consequential damages arising from the use of our site or products.
Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page and apply going forward.

Logo & Brand Design Terms
Core project process
The customer chooses a package, pays in full, completes the questionnaire and supplies required materials. Then HUA produces the included initial concept(s). If there are multiple concepts, the client must select one before revisions begin. After revisions and written approval, HUA prepares the final files.
Final written approval ends the revision stage. Any unused revisions expire at that point.
Timelines
The active turnaround clock only runs when HUA has everything needed to work. It pauses while waiting on required client information or decisions.
There is also a separate maximum overall project lifespan while having unused revisions they will be discarded:
Basics: 30 calendar days
Plus: 45 calendar days
Business Essentials: 60 calendar days
Unused revisions do not extend those limits.
Revision rules
A revision round is one consolidated set of changes submitted together by email.
A revision modifies the selected concept. It does not automatically include a completely new concept, new business name, new target audience, new identity, or fundamentally different creative direction.
Requests for several substantially different fonts, layouts, icons, palettes, etc. can be treated as additional concept development and quoted separately.
Multiple concepts
The two initial concepts in Plus/Essentials are there to select one direction, not to receive four rounds of revisions on both concepts.
Revisions only begin after one concept is chosen.
You can combine elements from both concepts if you decide it is reasonable, but if the request effectively creates a third new concept, it becomes additional paid work.
Secondary/icon logo
A secondary/icon logo is a simplified brand mark derived from the approved primary logo. It is not a separate logo concept, second business identity, or sub-brand.
Communication and meetings
Official revision requests, approvals, design instructions, content changes, and final approval are handled through email.
Texts/social messages will not be supported under any circumstances. Official project instructions must be confirmed by email.
Standard packages do not include lunch meetings, off-site meetings, phone consultations, video calls, or live design sessions.
Optional design consultation — $50/hour, in-store or by approved video call.
No off-site design meetings.
One decision-maker
Every project gets one designated primary client contact.
If owners, spouses, employees, committees, etc. disagree, they have to consolidate their feedback before giving it to you.
Conflicting instructions pause the project until one approved direction is provided.
Client inactivity
Client gets 3 business days to provide requested feedback, approvals, files, or information.
A fake response like:
“I saw it.”
“I’m thinking.”
“I’ll get back to you.”
does not reset the clock.
Only a substantive response containing the requested decision/information counts.
After the third business day, the project is paused.
The first client-caused pause is free, but the client loses their previous place/priority in the schedule.
The second and every later client-caused pause requires a $25 rescheduling fee before work resumes.
Inactivity accumulates across the entire project. The original 3-day grace periods themselves don’t count as inactive days; the overdue days after each grace period do.
At 10 cumulative business days of client-caused inactivity, HUA can close the project.
Closed / abandoned projects
Payments remain non-refundable.
A closed project can potentially resume from its prior stage for:
35% of the original package price, $50 minimum.
That currently equals:

Basics: $50
-
Plus: $87.50
-
Essentials: $192.50
Reactivated projects return to the current queue and do not regain their former completion date.
If the project stays inactive for 30 consecutive calendar days after closure, it may be treated as abandoned and require a completely new project at current pricing.
Payment / cancellation
Packages are paid in full before work begins.
Once design work begins, payments are non-refundable because time and scheduling were reserved.
If the client voluntarily quits after work has begun, they don't get refunded for unused concepts, revisions, or deliverables.
No downgrade refunds after work begins.
Upgrades can be allowed before final approval, but previous work/revisions carry forward; upgrading does not reset the project. Upgrading also does not grant another concept if from Basics to Plus or Basics to Essentials.
Proofreading
Before approval, the client must check business names, spelling, phone numbers, addresses, emails, URLs, dates, slogans, Scripture/text, etc.
HUA fixes errors HUA caused when identified before approval.
Client-requested content changes after final approval become additional work. If something has a unique spelling please let us know the proper spelling ahead of time.
Intellectual property / concepts
Commercial rights apply to the approved final logo only.
Rejected/unselected concepts remain HUA property and cannot be used, copied, traced, recreated, or handed to another designer without written permission.
Commercial rights do not mean trademark clearance or registration. The client is responsible for trademark searches/legal registration if they want them.
HUA can display finished work in its portfolio/site/socials/promotional materials unless otherwise agreed before the project begins.
Client-supplied assets
The client is responsible for having permission to use any images, logos, photos, fonts, artwork, slogans, trademarks, etc. they provide.
Reference logos/Pinterest images are inspiration only; HUA does not promise to copy another business's protected design.
Source files
.AI means the final production source file, not every sketch, alternate, draft, or internal working file.
Text may be outlined and elements may be expanded/flattened for compatibility.
Font files themselves are not included unless redistribution is legally allowed.
Apparel + stationery boundaries
The two apparel mockups in Business Essentials are mockups using the approved branding, not two custom shirt designs or physical garments.
The stationery design set is specifically:

1 two-sided business card for one contact profile

1 standard envelope

1 pen branding layout

1 notebook-cover layout
We will not be printing the stationery, that is used at customer discretion. Printing/manufacturing and extra employee cards/versions are separate.
File retention
HUA keeps final project files for at least 90 days after delivery.
Customer is responsible for downloading and backing them up.
Retrieval/re-export after 90 days is not guaranteed and may carry a fee.
Client delays don't become HUA emergencies
Client delays do not reduce Higher Up Apparel's remaining production time or require Higher Up Apparel to rush, work outside normal hours, or displace another client's project.
If rush service is possible, it gets separately priced.
We also added a fairness clause saying if HUA experiences a meaningful unexpected delay, you'll communicate it promptly.
Terms acceptance
By purchasing a logo or branding package, I confirm that I have reviewed and agree to Higher Up Apparel's Logo & Brand Design Terms, including project timelines, revision limits, communication requirements, inactivity policies, payment terms, and scope limitations.
